1. About these Terms
These Terms of Service (“Terms”) govern your access to and use of Joyna’s websites, mobile applications and related services (collectively, the “Services”).
They incorporate our Privacy Policy and Acceptable Use Policy.
By creating an account or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
These Terms are intended for users of Joyna in the United Kingdom.
2. Who we are
The Services are provided by Joyna Ltd (“Joyna”, “we”, “us”, “our”).
Our registered office is:
5th Floor, 167–169 Great Portland Street
London, United Kingdom, W1W 5PF
Company Number: 15197071
You can contact us at anna@joynarun.com.
3. Eligibility and accounts
You must be at least 13 years old to use Joyna.
If you are under 18, you should use Joyna with the involvement or permission of a parent or guardian where required.
When creating an account, you agree to:
provide accurate and current information;
keep your account information up to date;
keep your login credentials secure;
notify us if you believe your account has been accessed without permission.
You are responsible for activity carried out through your account unless that activity results from something for which Joyna is legally responsible.
You may be able to sign in using third-party authentication services such as Google or Apple. Those providers may also apply their own terms and privacy policies.
4. Privacy
Our Privacy Policy explains how we collect, use, share, retain and protect personal information.
Some Joyna features require access to your device location. During an active run, location may continue to be collected while the app is in the background or your screen is locked so that run-recording and active-run features can continue.
You can control location and other permissions through your device settings, although disabling permissions may prevent some features from working.
For privacy questions, contact anna@joynarun.com.
5. What Joyna provides
Joyna is a running application designed to help users find and complete running routes and access safety-related running features.
Depending on the version of the Services available to you, Joyna may provide features including:
running-route discovery;
routes informed by available lighting and crime data;
run recording and activity history;
Safety Pins or other user-submitted safety information;
trusted contacts;
Live Location or run-sharing features;
safety and service notifications;
achievement and progress features.
Features may change, be added or be removed over time.
6. Routes and safety information
Joyna uses available mapping, lighting, crime and other data to help provide running routes.
This information may be:
incomplete;
inaccurate;
outdated;
unavailable;
affected by conditions that Joyna cannot observe.
A route appearing in Joyna does not mean that the route is safe or free from risk.
Joyna cannot guarantee:
your personal safety;
the safety of a particular road, path or area;
that lighting will be working;
that crime or safety data is complete or current;
road or path accessibility;
traffic conditions;
weather conditions;
the behaviour of other people;
that a suggested route will remain suitable throughout your run.
You remain responsible for assessing your surroundings and deciding whether a route or activity is appropriate for you.
If circumstances appear unsafe, do not continue simply because a route was suggested by Joyna.
7. Live Location, trusted contacts and safety features
Joyna may allow you to add trusted contacts and share information about a run with selected contacts.
If you choose to use these features, information shared with selected contacts may include your location and progress during a run.
You are responsible for:
selecting appropriate trusted contacts;
ensuring that contact information you provide is accurate;
obtaining any permission required to provide another person’s contact information;
deciding when and with whom to share your location.
Live Location, Safety Pins, notifications and other safety-related features are intended to provide additional information or assistance. They are not emergency services.
Joyna does not guarantee that:
a trusted contact will receive or see an alert;
a notification will arrive immediately;
Live Location will always be available or accurate;
another person will respond to an alert;
mobile, GPS or internet connectivity will be available.
If you are in immediate danger or require emergency assistance, contact the appropriate emergency services.
8. Health and outdoor activity
Running and other outdoor activities involve inherent risks, including injury, traffic, environmental conditions and risks associated with other people.
You participate at your own risk and remain responsible for exercising appropriate judgment about:
your health and fitness;
weather;
traffic;
lighting;
route conditions;
surroundings;
personal safety.
Joyna does not provide medical advice.
If you have questions about whether an activity is suitable for you, seek advice from an appropriately qualified healthcare professional.
9. User-submitted information
Some Joyna features may allow users to submit information such as:
Safety Pins;
route feedback;
ratings;
comments;
other information relating to routes or the Services.
You retain ownership of information and content that you submit.
You grant Joyna a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display and use that material as reasonably necessary to:
operate the Services;
provide the feature through which it was submitted;
maintain and improve Joyna;
moderate content;
protect users and the Services.
Where information is anonymised so that it can no longer reasonably identify you, Joyna may retain and use that anonymised information.
You must not submit information that:
you do not have the right to provide;
infringes another person’s rights;
contains another person’s private information without permission;
is deliberately false or misleading;
breaches our Acceptable Use Policy;
is unlawful.
10. Acceptable use
You must comply with our Acceptable Use Policy.
You must not use Joyna to:
harass, threaten or harm another person;
impersonate another person;
misuse another person’s personal information;
manipulate safety information;
interfere with or disrupt the Services;
attempt to gain unauthorised access to Joyna or its systems;
introduce malware or malicious code;
use automated systems to abuse or overload the Services;
carry out unlawful activity.
We may remove content, restrict functionality, suspend accounts or terminate accounts where reasonably necessary to enforce these Terms, protect users, maintain security or comply with law.
11. Third-party services
Joyna relies on third-party services and technology, which may include services for:
maps;
authentication;
cloud infrastructure;
push notifications;
diagnostics;
app distribution;
payments.
Those services may be governed by separate terms and privacy policies.
We are not responsible for third-party services where responsibility rests with the relevant third-party provider.
12. Subscriptions and paid features
Joyna may offer paid subscriptions or paid features.
Where a subscription or purchase is made through the Apple App Store or Google Play:
payment is handled by the relevant app store;
billing is subject to that store’s terms;
cancellation and refund processes may also be handled by that store.
Prices and subscription terms will be displayed before you purchase.
Where a subscription automatically renews, the renewal terms and price will be shown before purchase.
You can cancel a subscription using the relevant app-store subscription controls.
Cancellation normally takes effect at the end of the current paid subscription period unless the relevant store provides otherwise.
13. Free trials and promotions
Joyna may offer trials, promotional periods or discounted access.
Any specific terms relating to a promotion or trial will be provided when it is offered.
Where a trial automatically converts to a paid subscription, this will be explained before you begin the trial.
14. Account deletion
You may delete your Joyna account using the account-deletion functionality available through the Services.
Information about account deletion is also available at:
[INSERT ACCOUNT DELETION WEBPAGE URL]
You can contact anna@joynarun.com if you require assistance.
Personal information will be handled following account deletion in accordance with our Privacy Policy and Data Retention Policy.
15. Suspension and termination
You may stop using Joyna at any time.
We may suspend, restrict or terminate access to the Services where we reasonably believe this is necessary to:
address a breach of these Terms or our policies;
protect other users;
protect the security or integrity of the Services;
prevent fraud or misuse;
comply with legal or regulatory obligations.
Where appropriate, we may provide information about the reason for enforcement action and an opportunity to appeal.
16. Intellectual property
Joyna and its software, designs, branding, graphics, interfaces and other materials provided by Joyna are protected by intellectual-property laws.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable right to use the Services for their intended purpose.
You must not copy, reproduce, distribute, sell, license, reverse engineer or create derivative works from protected parts of the Services except where permitted by law.
Third-party intellectual property remains the property of its respective owners.
17. Intellectual-property complaints
If you believe material available through Joyna infringes your intellectual-property rights, contact anna@joynarun.com and provide:
your contact details;
identification of the work or right you believe has been infringed;
identification of the relevant material;
an explanation of the alleged infringement;
any information reasonably necessary for us to investigate.
We may request additional information before acting on a complaint.
18. Beta and test features
We may make features available in beta, test or early-access form.
Such features may:
contain errors;
operate differently from final features;
be modified or withdrawn;
be unavailable from time to time.
We will identify beta or test functionality where appropriate.
If you provide feedback about Joyna, you permit us to use that feedback to develop and improve the Services without payment to you.
19. Service availability and changes
We aim to provide reliable Services but do not guarantee uninterrupted availability.
Joyna may temporarily become unavailable because of:
maintenance;
technical failures;
network problems;
third-party service outages;
security issues;
circumstances outside our reasonable control.
We may update, modify or discontinue parts of the Services where reasonably necessary to improve Joyna, maintain security, comply with law or develop the product.
Where a material change significantly affects users, we will provide reasonable notice where appropriate.
20. Warranties
Nothing in these Terms affects warranties or rights that cannot legally be excluded.
Subject to those rights, the Services are provided on an “as available” basis.
We do not guarantee that:
the Services will always be available;
every feature will operate without interruption;
route, map, lighting, crime or safety information will always be accurate or complete;
third-party systems will always operate correctly.
21. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
any other liability that cannot legally be excluded.
If you are using Joyna as a consumer, we are responsible for loss or damage that is a foreseeable result of our failure to use reasonable care and skill or our breach of these Terms.
We are not responsible for loss or damage that:
was not reasonably foreseeable;
results from your misuse of the Services;
results from your failure to take reasonable precautions;
results from circumstances outside our reasonable control.
Nothing in these Terms affects your statutory rights as a consumer.
If you use the Services for business purposes, to the extent permitted by law:
we exclude implied conditions, warranties and representations;
we are not liable for loss of profit, revenue, business opportunity or goodwill, or indirect or consequential loss;
our total liability arising from or connected with the Services in any 12-month period will not exceed the greater of:
the amount you paid to Joyna during that period; or
£50.
22. Communications
We may send communications relating to:
your account;
security;
service changes;
safety functionality;
support;
legal or policy updates.
These may be provided by email, push notification, in-app message or other electronic means.
Marketing communications will be sent only where permitted by law, and you can opt out of them.
23. Changes to these Terms
We may update these Terms from time to time.
If a change is material, we will provide reasonable notice where appropriate, for example through the app, website or email.
The effective date at the top identifies the current version.
If you do not agree to an updated version of the Terms, you should stop using the Services and, where appropriate, delete your account or cancel any subscription.
24. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
If you live in England or Wales, the courts of England and Wales will have jurisdiction over disputes relating to these Terms.
If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts.
Nothing in this section prevents you from relying on mandatory consumer protections that apply where you live.
25. General
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
Our failure or delay in enforcing a provision does not waive our right to enforce it later.
We may transfer our rights and obligations under these Terms where permitted by law. We will not do so in a way that reduces your legal rights without appropriate protection.
These Terms, together with the policies expressly incorporated into them, form the agreement between you and Joyna concerning use of the Services.

4. False or misleading safety information
Joyna relies in part on information submitted by users to support safety-related features.
You must not deliberately submit false, fabricated or misleading information through features such as Safety Pins, route feedback, ratings, comments or other safety-reporting functionality.
In particular, you must not:
knowingly make a false allegation about another person or location;
deliberately mark an area as dangerous or safe when you know that information is false;
manipulate Joyna’s safety information;
impersonate another person;
use false information to harass or target somebody.
We recognise that safety experiences can be subjective. This rule prohibits deliberately false or misleading submissions, not genuine reports made in good faith.

You must not use Joyna to:
threaten or encourage violence;
glorify or promote serious violent acts;
encourage another person to engage in dangerous or unlawful activity;
share gratuitously violent or graphic material.

suicide;
self-harm;

deliberately dangerous behaviour intended to cause serious physical harm.
Content discussing these subjects in a supportive, preventative or help-seeking context is not prohibited merely because it refers to them.
If you or someone else is in immediate danger, contact the emergency services.

information that could expose another person’s routine or whereabouts.
You should also consider your own safety before sharing information that could reveal your home address, regular routes or predictable routine.
10. Misuse of trusted contacts and Live Location
You must not misuse Joyna’s trusted-contact, Live Location or safety-alert functionality.
In particular, you must not:

removing or restricting submitted information;
limiting access to particular features;
issuing a warning;
temporarily suspending an account;
closing an account;
reporting conduct to law-enforcement or other authorities where required or appropriate.
The action taken will depend on factors such as the seriousness of the conduct, the risk to other people and whether breaches are repeated.
Where appropriate, we may provide information about the action taken and an opportunity to appeal.
14. Appeals
